Alabama HB 432, signed in 2023 and codified within AL Code Title 31, bars Birmingham and every other Alabama municipality from adopting sanctuary policies that limit cooperation with federal immigration authorities. Violators risk loss of state grant funding.
Alabama HB 432 prohibits any city, county, or law enforcement agency from enacting policies that restrict communication with U.S. Immigration and Customs Enforcement or that decline to honor lawful federal immigration detainers. The law builds on the earlier Beason-Hammon framework. Birmingham officials may not direct police to ignore ICE requests, and any local rule attempting to shield undocumented residents from federal enforcement is void. The state Attorney General can investigate complaints, and noncompliant jurisdictions face withholding of state grant dollars.
A finding of noncompliance can trigger loss of state-administered grants, civil enforcement by the Alabama Attorney General, and removal of officials who knowingly enforce a void sanctuary policy.
