Florida law (SB 82, effective 2019) prohibits local governments from banning vegetable gardens on residential property. Broward County residents can grow edible plants in their front yards. HOAs may regulate aesthetics but cannot ban food gardens.
Florida Senate Bill 82, effective July 1, 2019, prohibits local governments from regulating vegetable gardens on residential properties. This law was prompted by a high-profile case in Miami Shores. Under this statute, Broward County and its municipalities cannot ban front-yard vegetable gardens. HOAs may still impose reasonable aesthetic requirements (bed materials, maintenance standards) but cannot prohibit food production. Raised beds, container gardens, and in-ground plots are all permitted. Gardens must be maintained and not create nuisance conditions. Broward County's warm climate allows year-round growing. South Florida Water Management District irrigation restrictions may apply to garden watering.
No penalties for maintaining a vegetable garden. Local ordinances banning gardens are preempted by state law. Unmaintained gardens may still be cited under general property maintenance codes.
