Miramar, FL Noise Ordinances: Quiet Hours (2026)

Section 10-115 sets the general standard: the creation of any unreasonably loud, disturbing and unnecessary noise in the city is prohibited, and noises of such character, intensity and duration as to be detrimental to the life or health of any individual, or that disturb the public peace and welfare, are prohibited. Section 10-116 then lists specific acts the city declares loud, disturbing and unnecessary, making the list illustrative rather than exhaustive. Two of those acts set explicit nighttime hours. Under § 10-116(3), it is unlawful to play any radio, television, phonograph or musical instrument in such manner or with such volume, particularly during the hours between 11:00 p.m. and 7:00 a.m., as to annoy or disturb anyone in a dwelling, hotel, hospital or office nearby. Section 10-116(4) applies the identical 11:00 p.m. to 7:00 a.m. window to yelling, shouting, hooting, whistling or singing on the public streets so as to annoy or disturb the quiet, comfort or repose of any person nearby.

Section 10-117 carves out three exceptions to both sections: city vehicles on necessary public business, nighttime street or bridge repairs by the city, county or state when daytime work is impractical, and reasonable use of loudspeakers for noncommercial public addresses. Outside the quiet-hours window, the same conduct can still violate § 10-115's general prohibition if it is unreasonably loud and disturbs the peace, so 11:00 p.m. to 7:00 a.m. is a heightened-scrutiny window rather than the only enforceable hours.
