Miramar enforces the Florida Building Code Residential R314 and the Florida Fire Prevention Code (NFPA 101 / NFPA 72, 2021 editions) as adopted by the State Fire Marshal, plus Broward County local fire amendments. Smoke alarms are required in every sleeping room, outside each sleeping area, and on every story. F.S. 553.883 mandates 10-year sealed-battery alarms when battery units are replaced.
Miramar lies in the Broward County High-Velocity Hurricane Zone and adopts the Florida Building Code, Residential (FBC-R) along with the Florida Fire Prevention Code (FFPC, 8th Edition, based on NFPA 1 and NFPA 101, 2021) under F.S. 633.202 and Miramar Code of Ordinances Chapter 9 (Fire Prevention). FBC-R Section R314 requires smoke alarms in (a) each sleeping room, (b) outside each separate sleeping area in the immediate vicinity of bedrooms, and (c) on each additional story including basements and habitable attics. New construction and additions must be hardwired with battery backup and interconnected so that activation of one alarm sounds all alarms (R314.4-R314.6). For existing one- and two-family dwellings undergoing repair or a Level 1 alteration, F.S. 553.883 permits battery-operated alarms but requires that any newly installed or replacement battery alarm be powered by a non-removable, non-replaceable 10-year sealed lithium battery (effective January 1, 2015). NFPA 72 (2019/2022) governs alarm placement clearances from ceilings, HVAC vents, and bathrooms. Combination smoke/CO alarms are required where fuel-burning appliances or attached garages exist (R315). Hardwired installations require a permit from Miramar Building Division. Vacation rentals and DBPR-licensed lodging must additionally meet NFPA 101 single- and two-family or lodging/rooming house chapters.
Missing or inoperable smoke alarms are enforceable by Miramar Code Compliance and Miramar Fire-Rescue under Code Chapter 9 with daily fines up to $250/day (first violation) or $500/day (repeat) under F.S. Ch. 162. Selling or installing a non-compliant battery alarm violates F.S. 553.883 and may trigger Department of Business and Professional Regulation enforcement.
