Backyard composting is legal across Delaware County and encouraged by the county's Act 101 recycling program. There is no county compost permit, but municipal property-maintenance and nuisance rules require that piles not create odors, attract rodents or become a health hazard.
Delaware County promotes home composting as part of its Solid Waste Management Plan and mandatory recycling program under the PA Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101, 53 P.S. Β§4000.101 et seq.). Residential yard-waste and food-scrap composting is legal and needs no county permit. Regulation is municipal and nuisance-based: local codes typically require compost to be maintained so it does not generate offensive odors, attract vermin or rats, or harbor disease, and some set setbacks from lot lines or size limits. Large-scale or commercial composting is separately regulated by PA DEP. Yard-waste burning is generally not permitted; composting or municipal collection is the intended route.
A poorly managed pile can be cited as a public-health nuisance under the local property-maintenance code or the county health department, triggering an abatement notice, cleanup order and possible summary fine if the odor or vermin problem is not corrected.
