There is no Delaware County weed ordinance. Each municipality bans noxious weeds and overgrown vegetation through its own property-maintenance code. Lower Chichester Township, for example, forbids noxious plant growth and grass over twelve inches.
Weeds are regulated municipally, not by the county. A typical Delco ordinance, like Lower Chichester Township's §692.01, prohibits weeds or plant growth that are noxious or detrimental to public health, safety and welfare, plus grass exceeding a set height. Statewide, the PA Noxious Weed Control Law (3 Pa.C.S. Ch. 15) and the Department of Agriculture's controlled-plant and noxious-weed lists identify plants — such as poison hemlock and multiflora rose — that landowners must control. Cultivated gardens and crops are generally exempt from municipal height rules. Enforcement is complaint-driven through local code enforcement.
Municipalities issue a notice to cut, then abate the nuisance themselves if the owner does not comply. The mowing or removal cost is billed to the owner and, if unpaid, filed as a municipal lien; summary-offense fines may also apply.
