Section 7-28-120 of the Chicago Municipal Code requires property owners to control all weeds so the average height does not exceed 10 inches. Uncontrolled weeds exceeding this height are declared a public nuisance. The Department of Streets and Sanitation issues violation notices and may abate the nuisance. In emergencies posing imminent threat to public health, safety, or welfare, the city may act without notice. Abatement costs are charged to the property owner and may become a lien on the property. Chicago maintains a Native Plant Garden Registry that allows residents to register gardens containing native plants that might otherwise be reported as weed violations. Registered gardens must be maintained and clearly identifiable as intentional plantings.
Fines of $600 to $1,200 per offense. Each day of continued violation is a separate offense. Property liens may be placed for city abatement costs.
