Oak Park requires property owners to control weeds on their property. Noxious weeds and invasive species must be eradicated. Properties with excessive weeds receive violation notices and may be abated at the owner's expense, similar to grass height enforcement.
The Village of Oak Park requires all property owners to control weeds on their property as part of the general property maintenance code. Noxious weeds as defined by the Illinois Noxious Weed Law (505 ILCS 100) must be eradicated, including species such as Canada thistle, perennial sowthistle, and other state-listed plants. Properties must be kept free of rank vegetation and excessive weed growth. The Village Code Enforcement division treats weed violations similarly to grass height violations: when excessive weeds are identified, the property owner receives written notice with a compliance period of 5 to 7 days. If not addressed, the Village may abate the condition and charge the owner for the work. Naturalized gardens and prairie plantings are distinguished from weed violations if they are intentionally designed, properly maintained, and contain appropriate plant species rather than noxious weeds. Parkway areas and vacant lots are subject to the same weed control requirements. Property owners are responsible for the parkway strip between the sidewalk and curb in front of their property.
Weed violations result in written notice with a 5 to 7 day compliance period. Non-compliance leads to Village abatement at the owner's expense ($200-$400+), with costs becoming a lien on the property. Illinois Noxious Weed Law violations may carry additional state penalties.
