Elizabeth, NJ Landscaping Rules: Rainwater Harvesting (2026)

Rainwater harvesting in Union County is generally unrestricted and encouraged as a stormwater management technique. New Jersey has no statewide restrictions on residential rainwater collection for non-potable purposes (garden, lawn irrigation, non-potable indoor uses like toilet flushing with proper plumbing separation). NJ DEP and Rutgers Cooperative Extension Water Resources Program actively promote rain barrel programs to reduce stormwater runoff and combined sewer overflow impacts, particularly important in Union County's urbanized watersheds (Rahway River, Elizabeth River). Rain barrels (typically 55-gallon repurposed food-grade drums) installed at downspouts are exempt from NJ Uniform Construction Code permits. Larger systems (cisterns over 500 gallons, pump-assisted systems, or systems connected to plumbing) require building and/or plumbing permits under N.J.A.C. 5:23. Elizabeth, Westfield, and Cranford offer public education on rain gardens and rain barrels; Union County Department of Environmental Services has at times offered rain barrel rebate programs and bulk purchase discounts.
