Removing trees on private land in New Jersey is regulated by each municipality, which NJDEP now requires to adopt a tree-removal and replacement ordinance under the Tier A MS4 stormwater permit. Middlesex County controls only trees in county parks and along county roads.
Since the 2022 Tier A MS4 stormwater permit renewal, NJDEP has required every Tier A municipality, including all Middlesex County towns, to adopt an ordinance controlling tree removal and replacement. The NJDEP model regulates removal of any street tree 2.5 inches DBH or larger and any non-street tree 6 inches DBH or larger, generally requiring an application and replacement plantings. Exact thresholds, fees and ratios are set town by town, so check your municipality's tree ordinance first. Middlesex County does not issue tree-removal permits for private trees; its role is limited to county parks, open space and roadways. Trees in a municipal street right-of-way remain under that town's shade tree commission (N.J.S.A. 40:64).
Removing a regulated tree without the required municipal permit can trigger town fines and mandatory replacement plantings. Removing a county-park or county-road tree without authorization is a separate county violation.
