Palm Coast has no HVAC-specific noise ordinance. Air conditioners 'when functioning with the manufacturer's standard mufflers and noise-reducing equipment in use and when functioning in proper operating condition' are expressly EXEMPTED from the 'loud and raucous noise' rule under Sec. 35-54. The LDC also requires HVAC units visible from the right-of-way to be screened (LDC Sec. 11.03.01(H)).
Palm Coast's noise code gives HVAC equipment unusually explicit treatment. Chapter 35, Article II, Division 2, Sec. 35-54 ('Exempted noises') expressly exempts air conditioners 'when functioning with the manufacturer's standard mufflers and noise-reducing equipment in use and when functioning in proper operating condition according to the manufacturer's standards.' That exemption protects properly maintained AC condensers, heat pumps, and similar mechanical equipment from a Sec. 35-51 'loud and raucous noise' citation - but it does NOT protect equipment with failed compressors, missing fan-blade balance, removed sound shrouds, deteriorated mounting pads (causing vibration transmission), or other off-spec conditions, which can be cited under the general Sec. 35-51 standard. Pool pumps, generators, and other stationary mechanical equipment are not expressly exempted by Sec. 35-54 and are reachable under Sec. 35-51 whenever they meet the 'loud and raucous' test from 50+ feet away. Installation of HVAC equipment requires a Mechanical Permit from Palm Coast Building Services (386-986-3780) under the Florida Building Code. The Land Development Code (LDC) Chapter 11 imposes a separate screening duty: LDC Sec. 11.03.01(H) requires that 'mechanical equipment ... HVAC units, transformers, lift stations, utility cabinets, electrical panels, or cable television equipment shall be fully screened with planting beds in areas that are visible from the public right-of-way,' with screen height minimum 30 inches at installation. HOAs covering many Palm Coast subdivisions impose stricter equipment-placement, screening, and noise rules in their covenants.
Properly maintained AC equipment is exempt under Sec. 35-54. Failed or off-spec mechanical equipment (and pool pumps, generators, etc.) audible 50+ feet away is cited under Sec. 35-51 by Code Enforcement (386-986-3764). LDC Sec. 11.03.01(H) screening violations are cited separately by Code Enforcement.
