Per NYC Admin Code 24-222, construction activity is restricted to weekdays 7 AM-6 PM. Weekend, holiday, or after-hours construction requires an After-Hours Variance (AHV) from DEP, or a DOB emergency declaration. Jackhammers and pile drivers must comply with specific dBA limits and mitigation plans. Staten Island sites are subject to the same rules as the other four boroughs.
After-hours without AHV: 3,200-8,000 for repeat offenders. Excessive construction noise: 440-1,750 first offense.
