Construction hours in Lassen County, CA โ sometimes called construction noise rules or contractor work-hour ordinances โ set when contractors can run power tools, hammers, and heavy equipment.
In unincorporated Lassen County, construction noise is exempt from the Noise Ordinance during daytime hours. Section 9.65.070(a)(9) of the Lassen County Code exempts construction work from the noise limits between 7 a.m. and 7 p.m. Outside that window (7 p.m.-7 a.m.), the noise standards apply.
Lassen County's 2021 Noise Element explains that daytime construction noise is exempt from regulation under the Lassen County Noise Ordinance (Chapter 9.65) because construction is temporary and does not permanently change the ambient noise environment. Section 9.65.070(a)(9) of the County Code exempts construction work from the noise standards between 7 a.m. and 7 p.m. The Noise Element's implementation Action 1.1d directs the county to ensure noise-generating construction work does not occur between 7 p.m. and 7 a.m. (the accepted times of day are 7 a.m. to 7 p.m.). Construction noise occurring outside that window loses the exemption and becomes subject to the one-hour average sound-level limits of Section 9.65.040, measured at the property line of the nearest noise-sensitive receiver (for residences in agriculture zones, at the boundary of the yard area - a 50-foot radius - or property line, whichever is closer). The Planning Commission or Board of Supervisors may set tighter hours through the use-permit process for discretionary projects.
Construction noise before 7 a.m. or after 7 p.m. is not exempt and is enforceable under Section 9.65.040 as a public nuisance, via administrative citation under Lassen County Code Chapter 1.20. Use-permit conditions imposing stricter hours are enforced through the permit and code-enforcement process.
