Nevada County's General Plan Noise Element (Table 9.1) and matching zoning standard (Sec. L-II 4.1.7) set exterior noise limits in dBA by zoning district and time of day, ranging from 40 dBA Leq overnight in rural zones to 80 dBA in industrial zones.
The County of Nevada (California) sets numeric noise limits in the General Plan Noise Element, Table 9.1 (Noise Standards - Exterior Noise Limits), which are implemented through zoning standard Land Use & Development Code Section L-II 4.1.7. Limits vary by land-use/zoning category and time period and are expressed as both an Leq (average) and an Lmax (maximum). Rural zones (A1, AE, FR, TPZ, OS, IDR): 55 dBA Leq / 75 dBA Lmax daytime (7 a.m.-7 p.m.), 50/65 evening (7-10 p.m.), and 40/55 overnight (10 p.m.-7 a.m.). Residential and Public zones (RA, R1, R2, R3, P): 55/75 daytime, 50/65 evening, and 45/60 overnight. Commercial/Recreation: 70/90 daytime and 65/75 at night. Business Park: 65/85 day, 60/70 night. Industrial (M1, M2): 80/90 at any time. Compliance is determined by the mean average of at least three 20-minute measurements for the relevant time period, taken on property containing a noise-sensitive use. Where two zoning districts abut, the standard of the lower or more restrictive district plus 5 dBA applies (Sec. L-II 4.1.7.D.4). If measured ambient noise already exceeds the limit, the allowable level is set at 5 dBA above ambient.
Exceeding these exterior noise limits is a land-use noise violation handled by the County Code Compliance Division, which seeks voluntary compliance and can cite violators and refer continued non-compliance to Nevada County Superior Court.
