Anderson's noise ordinance controls noise from all sources, including industry. However, sounds within the normal range appropriate to a legally established, non-transient business are exempt, so lawful factory operations are generally protected.
Section 94.40 states the ordinance applies to the control of all noise within the city limits, expressly reaching industrial sources. General loud-noise limits (Section 94.42) apply, but Section 94.45(H) exempts sounds associated with the normal conduct of a legally established non-transient business within the normal range appropriate for such use. So a permitted plant running routine operations is protected, while abnormal, excessive or off-hours industrial noise disturbing neighbors can still be a public nuisance. Zoning of industrial uses is handled separately through Anderson's Zoning Ordinance under IC 36-7-4.
