CMC Chapter 909 regulates industrial noise. Section 909-3 sets maximum sound levels by zoning district, measured as Leq dB(A) over six-minute intervals. Nighttime mechanical equipment near homes requires a permit.
Industrial noise in Cincinnati falls under the community noise provisions of CMC Chapter 909. Section 909-3 establishes that no person shall create noise or permit the creation of noise in a manner that disturbs the peace and quiet of a neighborhood, taking into account the proximity of residences, hospitals, and other residential institutions. Maximum permissible sound levels are set in tables based on zoning district and day of the week, measured as Leq dB(A) over a minimum six-minute period using ANSI S1.4-compliant Type 1 or Type 2 sound level meters. The ordinance applies to manufacturing facilities, warehouses, and other industrial operations that generate noise affecting adjacent residential or commercial areas. Section 909-7 further restricts operation of mechanical apparatus producing loud sound within 500 feet of residences between 9 PM and 7 AM. Ohio municipalities are authorized to regulate noise under ORC 715.49, and industrial operations may also be subject to Ohio EPA noise guidance.
Minor misdemeanor for initial violations. Repeated offenses (three or more within one year) constitute a fourth-degree misdemeanor. Enforcement is by the Cincinnati Buildings and Inspections Department and Police Department. File complaints via Cincinnati 311 at (513) 591-6000.
