Sounds from industrial, commercial, timber-harvesting, or utility operations during normal operations are exempt from Clackamas County's noise code under 6.05.060(F). But commercial establishments next to homes cannot be unreasonably loud between 10 p.m. and 7 a.m.
Code 6.05.060(F) exempts sounds caused by industrial, commercial, timber-harvesting, or utility organizations or workers during their normal operations. Even so, 6.05.040(B)(13) makes unreasonably loud noise from a commercial establishment, including outdoor areas it controls, a per se violation between 10 p.m. and 7 a.m. if plainly audible five feet from a dwelling. Loading and unloading merchandise that is unreasonably loud is also prohibited under 6.05.040(B)(10). Blasting is limited to 9 a.m.-4 p.m. on weekdays unless a permit says otherwise (6.05.060(E)).
Late-night commercial noise near homes is a per se violation citable by the Sheriff, with Board-set fines and possible equipment seizure for repeat offenders.
