Rochester regulates industrial and manufacturing noise under its general excessive-noise prohibition. No separate dBA limit by zone is codified; all operations must avoid sound that endangers health or unreasonably disturbs a reasonable person.
Chapter 75 of the Rochester Municipal Code (adopted 10-23-1973, Ord. No. 73-564) prohibits any person from making or permitting excessive noise from any source, including industrial and manufacturing operations. Β§β―75-4 defines excessive noise as sound that endangers or injures human or animal safety, annoys or disturbs a reasonable person of normal sensitivity, or damages property. No zone-specific dBA ceiling for industrial facilities is set in Chapter 75; compliance is judged by the reasonable-person standard. Construction noise is separately restricted to 7β―AMβ10β―PM (Β§β―75-10). The Chief of Police administers and enforces the chapter (Β§β―75-20), and any person may file a signed complaint prompting investigation.
Violations are subject to penalties under Β§β―13A-11 of the Municipal Code; fines range approximately $50β$150 per ticket, doubling on default; each day may constitute a separate offense.
