Apex's downtown along North Salem Street - anchored by the historic Halle Cultural Arts Center and the surrounding 19th-century commercial buildings - hosts a heavy calendar of outdoor events including the popular Peakfest spring street festival, Halloween downtown trick-or-treat, Olde Fashioned Fourth of July, the holiday market, and a Friday-night summer concert series. The applicable Town Code provisions are: (1) Sec. 14-31 ('Sound emission standards and limitations') - the general Table 1 dB(A) cap at the complainant property line for more than ten percent of the measuring period (measured at least 10 ft inside the boundary per Sec. 14-30) applies to outdoor music on private property and at venues where sound carries to adjacent residential parcels. (2) Sec. 14-33 ('Other prohibited noises') - amplified sound from any radio, phonograph, mechanical loudspeaker, or other sound-magnifying device used on or over any town street is capped at 55 dB(A) measured at 20 feet from the device, regardless of zoning. (3) Sec. 14-32 ('Exceptions') exempts permitted parades, special events, and other authorized activities from the Sec. 14-31 caps. Town-permitted street festivals therefore operate under conditions approved by the Town Council that may include extended amplification windows, route closures, and sound-management plans. The Apex Police Department, Public Works, and Parks, Recreation & Cultural Resources Departments coordinate event logistics. Sunday or late-evening outdoor amplified events on private property (back-yard parties, restaurant patios, brewery taprooms such as Carolina Beverage Company / Hops & Hounds) remain subject to the Sec. 14-31 nighttime cap and may be cited if Table 1 levels are exceeded at a neighbor's property line. Construction-noise carve-outs in Sec. 14-33(7) (7 a.m.-7 p.m. weekdays, 9 a.m.-7 p.m. Saturdays) do not extend to amplified music.
Permit-less outdoor music exceeding Sec. 14-31 Table 1 dB(A) caps at the property line is a misdemeanor under N.C.G.S. 14-4 (up to $500 / 20 days). Amplified sound on town streets exceeding 55 dB(A) at 20 ft (Sec. 14-33) is similarly enforceable.
