Non-residential fences may exceed 7 feet with Planning Director approval for security or screening, and vinyl-coated chain link for single-family recreational uses such as tennis or basketball courts may be approved up to 10 feet.
Apex UDO Sec. 8.2.7.B.1 states: 'No freestanding fence or wall shall exceed seven feet in height including piers, posts, and finials. Non-residential fences or walls may be higher for security and/or screening purposes with approval by the Planning Director, after taking into account topography, unique site conditions, and unique safety, security, and screening requirements of the property owner.' Sec. 8.2.7.B.2 states: 'Fences and walls in front yards shall not exceed 48 inches in height. Piers or posts and finials may extend up to 6 inches higher than the finished fence or wall height.' For single-family recreational accessory uses 'such as tennis courts and basketball courts,' vinyl-coated chain link 'may be approved up to 10 feet in height by the Planning Director, after taking into account site topography, existing and proposed vegetative screening, setbacks, unique site conditions, and the nature of the single-family recreational accessory use.' Sec. 8.2.7.B.3 allows fences and walls in the controlled and limited access highway buffer, thoroughfare buffer, and streetfront buffer provided they meet the requirements of 8.2.7.E (Fences in Required Buffers) and the height requirements of 8.2.7.B.1 and B.2.
A residential front-yard fence taller than 48 inches (other than the 6-inch post/finial extension) violates Sec. 8.2.7.B.2. A freestanding rear-yard fence or wall exceeding 7 feet without Planning Director approval violates Sec. 8.2.7.B.1. Recreational chain link courts over 10 feet, or built without Planning Director approval, are out of compliance. Enforcement is handled by the Town of Apex Planning Department and Building Inspections.
