Section 634.05 (Maximum Permissible Sound Levels by Receiving Land Use Category) Table 1 sets the residential daytime cap at 60 dBA (7 a.m.-10 p.m.) and the nighttime cap at 50 dBA (10 p.m.-7 a.m. the following day). Retail areas are limited to 70 dBA at all times. Measurement is at or within the property boundary of the receiving land use, not the source. A violation of section 634.05 is a minor misdemeanor on a first offense (up to $150 fine) and a fourth-degree misdemeanor on subsequent offenses (up to 30 days jail and $250 fine). Malicious violations are third-degree misdemeanors (up to 60 days jail and $500 fine). Each day is a separate offense under section 698.02.
