Chapter 1276 of the Newark Zoning Code regulates fences across districts. In residential (R-S, R-1, R-2, R-3), conservation (CD), agricultural (AD), and commercial (CSI, OBCI) districts: no fence may exceed 4 feet above the adjacent ground in any yard (including front yard), and 6 feet in the side or rear yard. In Light Industrial (LI) and General Industrial (GI) districts, fences up to 8 feet are allowed in any yard. Barbed wire, metal prongs, spikes, cutting edges, and electrified fences are prohibited in non-industrial districts. Industrial districts may use barbed wire only above 7 feet with Board of Zoning Appeals approval.
Zoning violations under Ch. 1276 are enforced by the Newark Engineering & Zoning Department. Penalty follows Β§698.02 - typically a fourth-degree misdemeanor (up to $250) with each day a separate offense; the city can also order the fence removed at the owner's cost.
