Newark Zoning Code Ch. 1276 prohibits fences with wire, metal prongs, spikes, or cutting edges of any kind in residential and commercial zones, and bans electrified fences in all non-industrial districts.
Chapter 1276 expressly prohibits 'wire, metal prongs, spikes or cutting points or edges of any kind whatsoever' on residential or commercial fences. Electrified fences are prohibited in residential, conservation, agricultural, and commercial districts. Industrial districts (LI/GI) may use barbed wire, but only above 7 feet from the ground and only with Board of Zoning Appeals approval. Standard residential materials - wood pickets, vinyl, chain link (uncoated wire), composite, and ornamental aluminum - are all allowed within the height limits.
Installing a prohibited material is a Ch. 1276 violation enforceable as a Β§698.02 fourth-degree misdemeanor (up to $250) with each day a separate offense; the city can order removal.
