Baton Rouge fire code enforcement is grounded in the Louisiana State Uniform Construction Code (LSUCC), La. R.S. 40:1730.21 et seq., which adopts the IBC, IRC, IFC, IFGC, IMC, IPC, and NEC family of codes statewide. The current Louisiana adoption is the 2021 cycle of the I-Codes including the 2021 IFC. Enforcement is by the Baton Rouge Fire Department (BRFD) Office of the Fire Marshal in coordination with the Office of the Louisiana State Fire Marshal under La. R.S. 40:1563. IFC Section 308.1.4 prohibits open-flame cooking devices, charcoal burners, and other open-flame appliances on combustible balconies or within 10 feet of combustible construction in any structure containing 3 or more dwelling units. Exceptions: one- and two-family dwellings; balconies served by an automatic sprinkler system (NFPA 13 or 13R); listed electric grills; and listed LP-gas grills with cylinders not exceeding 1 pound. Baton Rouge's downtown high-rises, LSU-area apartment complexes (Tigerland), and Mid City multifamily buildings fall under this rule. NFPA 58 (Liquefied Petroleum Gas Code) adopted via LSUCC governs LP-gas cylinder storage: cylinders larger than 1 pound must be stored outdoors, upright, in a ventilated area, at least 5 feet from building openings. Garage and basement storage of propane cylinders is prohibited. At single-family homes, backyard grilling is unrestricted by City-Parish ordinance. Public grilling in BREC parks (Recreation and Park Commission for East Baton Rouge Parish) is permitted only in designated grilling areas with park-supplied or approved equipment.
Use of prohibited grill on multi-unit balcony: BRFD or State Fire Marshal citation, removal order, possible lease violation enforced by landlord. Indoor propane cylinder storage: NFPA 58/LSUCC violation, civil penalty under La. R.S. 40:1672 (State Fire Marshal authority), mandatory cylinder removal. Fires causing property damage create personal liability and possible criminal charges under La. R.S. 14:51-54 (arson statutes) for reckless conduct.
