Backyard propane and charcoal grilling is allowed in unincorporated El Paso County. Cooking fires are exempt from the outdoor-burning ban, but a Commissioners Court burn ban can still restrict open-flame use during severe drought.
TCEQ rule 30 TAC Sec. 111.207 expressly authorizes fires used 'in the noncommercial preparation of food,' so backyard barbecue grills, propane grills and charcoal cooking are permitted in unincorporated El Paso County. Propane cylinders for grills are covered by the Railroad Commission's LP-Gas Safety Rules (16 TAC Chapter 9 / NFPA 58) for safe handling and storage. During a severe drought, a Commissioners Court burn ban under Loc. Gov't Code Sec. 352.081 may temporarily restrict open flames and outdoor charcoal fires, though enclosed propane grills are often still allowed; always check the current order. In El Paso's dry, windy desert conditions, keep grills clear of dry brush, fences and structures.
Grilling generally does not violate any ordinance, but using an open charcoal or wood cooker during an active burn ban that restricts open flames can be a Class C misdemeanor, and an escaped cooking fire creates wildfire liability.
