In Summit County, single-family and duplex owners may grill on their own decks, but the Ohio Fire Code bans charcoal and propane grills on combustible balconies or within 10 feet of combustible construction in multi-family buildings. Small one-pound propane units have limited exceptions.
Ohio Fire Code section 308.1.4 (OAC 1301:7-7-03) prohibits operating charcoal burners and open-flame cooking devices on combustible balconies or within 10 feet of combustible construction, and bars LP-gas containers over one pound on such balconies. This means a standard 20-pound propane grill cannot legally be used on a wooden apartment or condo balcony in Summit County. The rule exempts one- and two-family dwellings, so those owners may grill on their decks. LP-gas devices with a container of 2.5-pound water capacity (nominal one pound) may be allowed with fire-code-official approval and safety measures. Condo and HOA rules, plus insurance policies, often add stricter grilling limits.
Fire officials may order a prohibited grill removed; Ohio Fire Code violations bring correction notices and fines, and grilling against condo or lease rules can trigger eviction or coverage disputes.
