Ohio Fire Code rule 1301:7-7-03 provides that charcoal burners and other open-flame cooking devices shall not be operated on combustible balconies or within 10 feet of combustible construction. Exceptions: the rule does not apply to one- and two-family dwellings, nor to multi-family buildings whose balconies/decks are protected by an automatic sprinkler system. Any device using a fuel container larger than one pound is prohibited on combustible decks and balconies, so a full-size 20-pound propane grill is not allowed on an apartment balcony. Natural-gas devices may be permitted on multi-family balconies only with written fire-code-official approval. This statewide rule is enforced by your city/township fire official.
Operating a prohibited grill on a balcony is a fire-code violation; the fire code official may order removal and issue fines.
