New Orleans enforces fire-prevention rules through the New Orleans Fire Department under the Louisiana State Uniform Construction Code (LSUCC) adopting the 2018 International Fire Code and City Code Chapter 26 (Building Code). IFC § 308.1.4 prohibits charcoal burners and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction at apartments, condominiums, and similar multi-family residences. LP-gas (propane) containers larger than 1 pound are similarly restricted. Exceptions apply where the building is fully sprinklered or the device is electric. For single-family detached homes there is no city restriction on backyard charcoal, propane, or natural-gas grilling. The Vieux Carré (French Quarter) has particularly strict enforcement of IFC § 308 due to the dense, predominantly wood-frame historic construction; the New Orleans Fire Department and Vieux Carré Commission jointly enforce. Some VCC-approved properties have additional restrictions on courtyard grilling. Faubourg Marigny, Tremé, Bywater, and other historic districts face similar density concerns under HDLC oversight. New Orleans does not declare burn bans because the humid subtropical climate keeps fire weather low; Louisiana Department of Agriculture and Forestry may declare statewide burn bans rarely. Hurricane preparation rules under City Code Chapter 34 require securing or removing outdoor grills before evacuation orders. Tailgate grilling at Caesars Superdome game day events is supervised by NOFD.
IFC § 308.1.4 violations on multi-family balconies are City Code violations with fines up to $500 per day under City Code Section 6-22. Vieux Carré violations may carry additional VCC enforcement. Building fires caused by grill misuse can result in criminal negligence charges under Louisiana Revised Statutes Title 14.
