Virginia Beach enforces the Virginia Statewide Fire Prevention Code (VSFPC), which adopts the International Fire Code. IFC Β§308.1.4 prohibits open-flame cooking devices and LP-gas grills on combustible balconies or within 10 feet of combustible construction in buildings with 3 or more dwelling units. Single-family backyard grilling is unrestricted. Beachfront grilling has additional public-area rules.
Virginia Beach's fire code is the Virginia Statewide Fire Prevention Code (VSFPC) adopted under Va. Code Β§27-94 et seq., which incorporates the 2018 International Fire Code with Virginia amendments. Enforcement is by the Virginia Beach Fire Department Fire Prevention Bureau under the Fire Marshal. IFC Section 308.1.4 prohibits open-flame cooking devices, charcoal burners, and other open-flame appliances on combustible balconies or within 10 feet of combustible construction in any structure containing 3 or more dwelling units. Exceptions: one- and two-family dwellings; balconies served by an automatic sprinkler system; listed electric grills; and listed LP-gas grills with cylinders not exceeding 1 lb. Many Virginia Beach oceanfront condos and resort towers are subject to this rule. NFPA 58 (adopted via VSFPC) governs LP-gas storage: cylinders larger than 1 lb must be stored outdoors, upright, in a ventilated area, at least 5 feet from building openings. At single-family homes, backyard grilling is unrestricted by City code. Public beach grilling: Virginia Beach Code Β§6-115 and the City Beach Rules prohibit open fires on the public beach (except in designated fire rings such as those at Sandbridge), and portable grills must be off the sand by 9 PM; grilling near boardwalks must respect VSFPC clearance rules. Some HOA-governed resort areas have stricter rules.
