Brazoria County has no dark-sky lighting ordinance. Texas limits which local governments may regulate outdoor lighting, and unincorporated county authority is generally reserved for areas near major observatories or military bases β not Brazoria County.
There is no Brazoria County dark-sky or outdoor-lighting ordinance. Under Texas Health & Safety Code Ch. 425, general authority to regulate outdoor lighting rests with municipalities and a small number of specially authorized counties β chiefly those within the 57-mile protection zone around the McDonald Observatory in far West Texas (Jeff Davis, Brewster, Presidio and neighbors) or near military installations. Brazoria County is not among them. State law does require cutoff (shielded) fixtures on many facilities that receive state funds, but that is not a county rule. Residents concerned about a neighbor's lighting rely on private nuisance law or, inside a city, the municipal code.
No county penalty exists; state-funded facility lighting standards are enforced by the funding entity, and light disputes between neighbors are civil nuisance matters.
