No person may park a commercial vehicle in excess of 10,000 pounds GVW for more than three hours on private property, in any prohibited zoning classification, or in the right-of-way in unincorporated Marion County, with limited exceptions for delivery, loading/unloading at an approved business, and 24-hour emergency vehicles.
Marion County Land Development Code Section 4.3.21 ('Parking of commercial vehicles'), adopted by Ordinance No. 13-20, prohibits parking a commercial vehicle in excess of 10,000 pounds GVW for more than three hours on private property, in any prohibited zoning classification, or in the right-of-way, except in three circumstances. The exceptions are: (1) vehicles engaged in delivery or pickup of goods, or in delivering materials for bona fide repair, alteration, remodeling, or construction of a building for which a building permit was previously obtained, or for public works projects; (2) a vehicle parked in connection with and owned or leased by an approved business in a non-residential zoning district, or loading/unloading goods adjacent to a loading dock or loading area for up to 48 hours; and (3) utility company vehicles used for 24-hour emergency on call, ambulances or other public service vehicles, tow trucks (26,000 lbs GVW or less), and other commercial vehicles used for life-safety emergency purposes on a 24-hour basis that park on private property. The three-hour limit and the right-of-way prohibition apply to the unincorporated areas of the county.
Parking a commercial vehicle in violation of Section 4.3.21 is a Land Development Code violation enforced by Marion County Growth Services Code Enforcement under the Code of Ordinances code enforcement provisions (Chapter 2, Article V), subject to notice, citation, daily fines, and abatement.
