Residents may not paint curbs to reserve or restrict parking. Curb markings are official traffic-control devices installed only by the municipality or road authority.
Neither McHenry County nor its cities allow private residents to paint or mark curbs to claim parking, create no-parking areas, or designate loading zones. Curb color markings (such as yellow or red no-parking zones) are official traffic-control devices that only the municipality, McHenry County Division of Transportation, or IDOT may install, and only they may enforce them. Under the Illinois Vehicle Code (625 ILCS 5/11-304), local authorities control the placement of traffic-control devices; an unauthorized marking is not enforceable and may itself be a defacement or nuisance violation. If you want a parking restriction near your property, petition your city or the county road authority rather than painting the curb yourself.
Unauthorized curb painting can be treated as defacing public property or an unlawful traffic device, subject to municipal fines and removal/restoration costs.
