Under the Fireworks Regulation Act (425 ILCS 30), consumer and display fireworks are unlawful for the public; there is no 'buy them out of state and shoot them at home' loophole. The Act defines fireworks broadly (firecrackers, sky rockets, Roman candles) but excludes novelty items whose sale and use are permitted at all times: sparklers, snake/glow-worm pellets, smoke devices, party poppers, snappers, trick matches, and toy caps. Municipalities such as Crystal Lake and Woodstock may further restrict novelties on public property. Professional displays require a state-licensed operator and a permit from the local fire authority under the Pyrotechnic Use Act (425 ILCS 35).
Illegal fireworks are subject to seizure. Violations are a criminal offense reaching a Class A misdemeanor (up to one year in jail and a $2,500 fine); repeat offenses carry stiffer penalties.
