Driveway construction in Suffolk County requires town building permits and curb cut approval from Suffolk County DPW when accessing County Routes (CR). Stormwater requirements apply to driveways over 500 sq ft under MS4 rules.
Suffolk County Department of Public Works issues curb cut permits for driveways accessing County Roads (CR 16, CR 39, CR 46, etc.). Town building departments issue permits for driveway construction on town roads. Driveways must not slope steeper than 10% toward the garage per NY Residential Code. New or expanded driveways over 500 square feet in the Peconic Bay watershed or designated MS4 areas require stormwater mitigation (drywells, pervious pavers). Town of Southampton 330-106 requires driveway setbacks of 5 feet from side property lines.
Unpermitted curb cuts: $500-$2,500 and restoration order. Stormwater violations under NY SPDES: up to $37,500 per day.
