Chapter 1325 establishes an expedited, streamlined permitting process for electric vehicle charging stations in unincorporated Sutter County, adopted under California AB 1236 and Government Code Section 65850.7 (Ordinance 1716, 2024). EV charging stations are treated as a permitted or accessory use and are not subject to design review.
Electric vehicle charging in unincorporated Sutter County is governed by Chapter 1325 (Electric Vehicle Charging Station Expedited Permitting Process), added by Ordinance No. 1716 on February 27, 2024. Section 1325-010 states the chapter's purpose is to create an expedited, streamlined permitting process compliant with Assembly Bill 1236 (Chapter 598, Statutes 2015) and Government Code Section 65850.7, to achieve timely and cost-effective installation of charging stations and to expand the ability of residential, agricultural, and commercial property owners to install them. Section 1325-020 applies the chapter to the permitting of EV charging stations in the unincorporated territory of Sutter County; systems lawfully established before the Building Official's expedited process took effect are not subject to the chapter unless materially altered. Section 1325-030 defines an electric vehicle charging station as equipment built in compliance with Article 625 of the California Electrical Code and permits electronic submittal of applications. Section 1325-040 provides that establishing an EV charging station is a permitted or accessory use consistent with the Zoning Code and is not subject to design review, and requires compliance with the California Electrical Code, SAE, NEMA, Underwriters Laboratories, and applicable Public Utilities Commission rules. Section 1325-050 allows electronic submittal and electronic signatures and sets expedited review with a written correction notice for incomplete applications. Statewide CalGreen building standards for EV-ready and EV-capable spaces in new construction also apply through the County's adopted building codes.
Installing an EV charging station without the required building/electrical permit, or building one that fails to comply with Article 625 of the California Electrical Code and the safety standards listed in Section 1325-040, would violate the chapter. The process is designed to be expedited, so most compliant residential installations are routine.
