Chapel Hill Chapter 21 of the Town Code does not contain a single citywide overnight street parking ban for passenger cars and light trucks. Outside of the 16 Residential Parking Permit (RPP) zones (where overnight parking by non-permit holders may be prohibited during posted enforcement hours), properly registered, operable vehicles may park on most public streets overnight subject to posted no-parking signs, NCGS 20-162 distance restrictions, and the Town's abandonment thresholds. NCGS 20-162(a) provides: 'No person shall park a vehicle or permit it to stand, whether attended or unattended, upon a highway in front of a private driveway or within 15 feet in either direction of a fire hydrant or the entrance to a fire station, nor within 25 feet from the intersection of curb lines or if none, then within 15 feet of the intersection of property lines at an intersection of highways.' The Town's published parking rules require parking no farther than 12 inches from the curb, prohibit sidewalk parking anywhere in Town limits, prohibit blocking driveways, and prohibit parking across the center line. Downtown meter enforcement runs only 8:00 a.m. to 6:00 p.m. Monday through Saturday, with Sundays, Town holidays, and all Saturdays in July and December not enforced - so on-street meter zones are functionally free overnight (but still subject to the 3-hour limit during enforcement hours). For overnight stays beyond a few days, Chapel Hill's Town-published thresholds apply: 'Town-owned property: 24 hours maximum before considered abandoned' and 'public streets/highways: 7 days maximum before considered abandoned.' Citywide, NCGS 20-137.7 defines an 'abandoned vehicle' as 'a motor vehicle that has remained illegally on private or public property for a period of more than 10 days without the consent of the owner or person in control of the property.' NCGS 160A-303 authorizes the Town by ordinance to remove and dispose of abandoned vehicles. In the RPP zones, residents have up to ten 3-day visitor permits per year at $2 each, and up to five 7-day visitor permits at $10 each, for guests staying overnight. Many Chapel Hill subdivisions have HOA covenants that impose stricter overnight parking rules on private streets and driveways, enforced privately by the HOA.
Parking overnight in a posted no-parking zone, on a sidewalk, in front of a private driveway, within 15 feet of a fire hydrant or fire station entrance, or within 25 feet of a curb-line intersection violates NCGS 20-162 and Chapel Hill Code Chapter 21, Article IV. Parking overnight in a posted Residential Parking Permit (RPP) zone during enforcement hours without a valid permit or visitor permit is citable. A vehicle left on Town-owned property for more than 24 hours, or on a public street or highway for more than 7 days, may be processed as abandoned and towed under NCGS 160A-303 and Chapter 21. After 10 days illegally without consent, NCGS 20-137.7 deems a vehicle abandoned regardless of location.
