Miami Beach, FL Permit Requirements: Deck & Patio Permits (2026)

Miami-Dade County's deck and patio permit requirements reflect the South Florida Building Code's stringent wind resistance standards. Wood decks 18 inches or less above ground level do not require a building permit. Open concrete patios, walkways, and paver installations (other than screened patios and pool slabs) are also exempt from building permits. Elevated decks, covered patios, screened enclosures (screen rooms), and any structure attached to the house require building permits with engineered plans meeting the 185 mph wind design speed. Screened patios and pool enclosures are extremely common in South Florida and must be designed to withstand hurricanes — these require full engineering drawings. Pergolas and gazebos require permits as standalone structures that must resist wind loads. Electrical work on decks and patios (outlets, fans, lighting) requires a separate electrical permit with GFCI protection. Permits are submitted through the county's online portal. The revised fee schedule took effect October 1, 2025. Plan review ranges from 24 hours for simple projects to 10 business days.
