Pool barriers in Miami Beach must comply with Miami-Dade County Code Section 33-12, Florida Statute 515.29, and the Florida Building Code. Barriers must be a minimum of 48 inches high measured from the outside finished grade. The barrier must completely enclose the pool area, prohibiting unrestrained access. Acceptable barrier materials include screened-in patios, wooden fences, wire fences (2-inch chain link diamond weave nonclimbable type with top rail, heavy galvanized material), rock walls, concrete block walls, or approved equivalents that blend with the property's architecture. Gates must be self-closing and self-latching with latches placed at least 54 inches above grade on the pool side. Gates must be locked when the pool is not in use. Due to Miami Beach's HVHZ designation, pool enclosures and screen rooms must meet enhanced wind load ratings. Building permits from the Building Department at (305) 673-7610 are required for all pool barrier construction. Property owners are responsible for ongoing barrier maintenance.
Pool barrier violations are enforced by Code Compliance at (305) 673-7555. Failure to maintain required barriers may result in violation notices, fines, and mandatory corrective action. Repeat violations escalate through the Code Enforcement Board with potential daily fines.
