The City of Miami enforces swimming pool barrier requirements per Florida Statute 515.29 and the Florida Building Code Section 424.2. Every residential pool, spa, and hot tub must be enclosed by a permanent barrier at least 48 inches high on the exterior side. Barriers must be non-climbable with no openings larger than 4 inches. Gates must be self-closing and self-latching with the latch on the pool side at least 54 inches above grade. Approved types include screened-in patios, wooden fences, chain-link with top rail, and masonry walls. No final pool inspection is granted until the barrier is verified. Miami-Dade Code Section 33-12 adds local requirements for materials and maintenance.
Pool barrier violations are enforced by Miami Building Department. Non-compliant pools face immediate stop-use orders. Fines range from $250 to $1,000. Pool cannot be filled until barrier passes final inspection.
