Miami previously required EV-ready parking spaces in new construction, but Florida Senate Bill 1084 (effective July 2024) preempts local EV charger regulation. State law now governs EV charging station requirements statewide.
Prior to July 2024, the City of Miami required approximately 20% of parking spaces in new construction to be EV-ready. However, Florida SB 1084, signed by Governor DeSantis and effective July 1, 2024, preempts local governments from enacting or enforcing ordinances relating to electric vehicle chargers. EV charging regulation is now exclusively a state function. The Miami Parking Authority continues to operate Level 2 charging stations in city-owned garages at market rates. Residential condominiums may install EV chargers subject to Florida Statute 718.113, which protects unit owners' rights to install charging equipment in their assigned parking spaces. HOAs cannot unreasonably restrict EV charger installation under state condominium and homeowner association law.
No city-level violations for EV charging apply following state preemption. Unauthorized use of EV-designated parking spaces in city garages may result in parking citations.
