Miami Beach previously adopted EV-ready parking requirements for new construction, but Florida Senate Bill 1084 (effective July 2024) preempts all local EV charger regulation. The city continues to operate public EV charging stations in municipal garages including Tesla Superchargers.
The City of Miami Beach adopted Ordinance No. 2016-3988 establishing electric vehicle parking requirements for new construction. However, Florida SB 1084, signed by Governor DeSantis and effective July 1, 2024, preempts local governments from enacting or enforcing ordinances relating to electric vehicle chargers. EV charging regulation is now exclusively a state function. The city's Parking Department continues to operate public EV charging infrastructure including Tesla Superchargers at the 1661 Pennsylvania Avenue garage and Level 2 chargers at multiple city-owned facilities. Residential condominium owners retain the right to install EV chargers in their assigned parking spaces under Florida Statute 718.113, which prevents HOAs and condo associations from unreasonably restricting EV charger installation. No city-level violations for EV charging apply following state preemption. Unauthorized use of EV-designated parking spaces in city garages may result in standard parking citations.
