Section 46-152(b) of the Miami Beach noise article targets amplified sound equipment specifically: radios, televisions, musical instruments, phonographs and any other device for producing or reproducing sound cannot be run loud enough to disturb neighbors' peace and quiet, or louder than needed for voluntary listeners inside the room or vehicle where it plays, at any hour. , the standard tightens into a bright-line test: if the sound is audible 100 feet or more from a building or structure, or 25 feet or more from a vessel, floating structure or vehicle, that alone is 'prima facie evidence' of a violation, shifting the burden to the operator.

Responsibility is broad under Sec. 46-153: the property owner or manager, any performer or DJ, whoever controls the volume knobs, and the business tax receipt holder are all jointly and severally liable. Enforcement follows Sec. 46-158's warning ladder, one oral courtesy warning, then a written warning, before a formal notice of violation, except that violations from vehicles, bicycles or vessels skip straight to a notice of violation. Fines escalate under Sec. 46-159(a) from $250 for a first offense to $1,500, $3,000, $4,000 and $5,000 for the second through fifth offenses within 12 months, with business tax receipt or accessory-use restrictions layered on starting at the fourth offense.

Sec. 46-157(11) carves out a narrow entertainment-district exemption for live or amplified sound projecting east from stretches of Ocean Drive and Collins Avenue, unless it reaches a residential building to the east that the source doesn't own.
