Hialeah, FL Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Article V of Chapter 58 is Hialeah's noise article. Sec. 58-46 defines 'noise disturbance' as any sound in quantities that is or may be potentially harmful or injurious to human health or welfare, or that unreasonably interferes with the enjoyment of life or property of a reasonable person with normal sensibilities; 'noise' itself is defined more broadly as any sound that annoys or disturbs humans or causes adverse psychological or physiological effects. Sec. 58-47(a) then makes it unlawful to operate, play or permit the operation or playing of a radio, television, tape, record, CD, DVD, musical instrument or other machine or device for producing, reproducing or amplifying sound that creates a noise disturbance beyond the physical boundaries of the property, specifically in a residential neighborhood or in a mixed-use neighborhood combining commercial and residential zoning.

The standard is a reasonable-person nuisance test rather than a fixed decibel number: there is no numeric decibel limit written into this section. Sec. 58-48 exempts several categories from the whole article, including noise for alerting people to emergencies, noncommercial public speaking and assembly conducted under lawful authority, and aircraft noise governed by federal law. No dedicated fine appears in Article V, so violations fall under the Code's general civil-infraction penalty in Sec. 00 per violation with daily continuing violations charged separately.
