For properties within Miami Beach's historic preservation districts (Art Deco Historic District, North Beach Resort Historic District, and others), a Certificate of Appropriateness from the Historic Preservation Board may be required for fences visible from public rights-of-way. The permit process includes review for compliance with height limits, setback requirements, material restrictions, and visibility triangle requirements. Pool barrier fences have separate permit requirements that must be obtained simultaneously with pool permits under Section 33-12.
