Philadelphia's deck permit requirements are tiered based on size and elevation. Decks in the rear yard accessory to one-family dwellings that comply with the Zoning Code (Title 14) also do not require a permit. For decks that do need permits, residential decks up to 216 square feet (excluding roof decks) may qualify for an EZ permit β a simplified permit that does not require architectural plans. EZ permits are processed faster than standard building permits. Decks larger than 216 square feet require full building permits with plans. Roof decks always require full permits with structural engineering review. Elevated decks require guardrails meeting building code specifications. Concrete patios at grade level generally do not require permits. The Department of Licenses and Inspections (L&I) processes all permit applications. In historic districts, the Historical Commission may review deck proposals, particularly roof decks visible from the public right-of-way.
Unpermitted decks face L&I violations and may require retroactive permitting. Structurally deficient decks can result in stop-work or vacate orders. Roof decks without permits are serious violations. EZ permit violations can result in fines and mandatory compliance.
