Johns Creek has no specific garage-sale or yard-sale permit ordinance. Occasional residential sales are treated as an incidental use of the home, but they remain subject to the city's nuisance, property-maintenance, and sign rules, and the city will not list private sales on its website.
A review of Johns Creek's Code of Ordinances and Zoning Ordinance found no dedicated garage-sale or yard-sale chapter, permit requirement, or definition (the zoning definitions in Appendix A, Article III, contain no "yard sale," "garage sale," or "rummage sale" entry). In practice this means occasional residential garage sales are allowed as an incidental, accessory use of a dwelling without a city permit. However, several general rules still apply. The Nuisance Ordinance (Sec. 30-1) lets the city act against conditions such as obstruction of a public street or sidewalk without a permit and other annoyances, so a sale cannot block traffic or rights-of-way. The property-maintenance standards (no rubbish accumulation, no improper outside storage) mean leftover items must be cleaned up promptly. Temporary signs are regulated by the city's Sign Code; "illegal signs" that do not meet the Sign Code are listed among the city's common violations, so sale signs placed in the public right-of-way or that otherwise violate the Sign Code can be removed. The city's own posting guidelines note it does not list private estate or garage sales and reserves the right to refuse submissions that violate city policies, permits, or ordinances. Homeowners should also check any HOA rules, which often impose their own limits.
There is no permit to obtain, so there is no permit penalty. Problems usually arise from sign or nuisance violations: improperly placed temporary signs can be removed, and obstruction or nuisance conditions can draw a citation under the general penalty (Sec. 1-7), up to $1,000.00 and/or six months.
