Johns Creek regulates nighttime noise through Chapter 30 (Nuisances), Article II, of its Code of Ordinances. Section 30-20(a)(2), Table 1, divides the day into two periods at residential receiving properties: daytime (7:01 a.m. to 11 p.m.) with limits of 55 dBA / 60 dBC, and nighttime (11:01 p.m. to 7 a.m.) with the stricter limits of 40 dBA / 50 dBC. Officers may measure sound at the receiving residential property using A- and C-weighting on a Type 2 sound level meter, taking a reading of at least one minute when wind is under 15 mph. As an alternative to metering, Section 30-20(a)(1) lets an officer cite amplified sound from an entertainment venue that is 'plainly audible' at a home, defined as a listener with normal hearing being able to distinguish speech, bass, or musical rhythms without a listening device. The ordinance was adopted by Ordinance No. 2016-06-08 (July 25, 2016). Separately, landscaping equipment, construction, and trash collection have their own time windows under Section 30-20(b)-(d).
Repeat nuisance violations carry progressive minimum fines under Section 30-22(d): $250 for a second violation, $500 for a third, and $1,000 for four or more within a rolling 12-month period. Under the general penalty in Section 1-7, any code violation is punishable by a fine up to $1,000, up to six months imprisonment, or both, with each day a separate offense.
