Construction and land-disturbance activity in Johns Creek is barred from 7 p.m. to 7 a.m. on weekdays, before 8 a.m. or after 5 p.m. on Saturday, and entirely on Sundays and six listed holidays, unless it is emergency work or the community development director grants special permission.
Johns Creek limits construction noise through Section 30-20(c) of its Code of Ordinances (Chapter 30, Nuisances). The section provides that 'construction for land disturbance and building activity shall not be performed between the hours of 7:00 p.m. and 7:00 a.m. on weekdays, before the hour of 8:00 a.m. or after the hour of 5:00 p.m. on Saturday, or at any time on Sunday, New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day.' The only exceptions are activities deemed 'emergency work' (work to prevent or relieve imminent physical trauma or property damage, or utility restoration) or where 'special permission has been granted by the community development director.' Construction is defined in Section 30-18 as any site preparation, assembly, erection, repair, alteration, or demolition of buildings or structures, excluding work initiated by a government entity. The provision was adopted by Ordinance No. 2016-06-08 (July 25, 2016). The city's Community Development Department publishes an Hours of Construction guidelines form for contractors seeking exceptions.
Construction-hours violations are nuisance offenses enforced under Chapter 30. Section 30-22(d) sets progressive minimum fines of $250, $500, and $1,000 for the second, third, and fourth-or-later violations in a 12-month period, and Section 1-7 allows a fine up to $1,000 and/or up to six months imprisonment, with each day a separate offense.
