Under the adopted IPMC (Section 308), exterior property and structures must stay free of accumulated rubbish or garbage, and occupants must dispose of rubbish by placing it in approved containers. Solid waste carts must be removed from the collection point within 24 hours of pickup.
Johns Creek's property maintenance standards come from the 2018 International Property Maintenance Code (with Georgia Amendments) enforced by the Code Compliance Division. IPMC Section 308 (Rubbish and Garbage) requires that all exterior property, premises, and the interior of every structure be free from any accumulation of rubbish or garbage, and that every occupant dispose of rubbish in a clean and sanitary manner by placing it in approved containers. Separately, the city's solid waste rules (Code Sec. 42-29) govern the carts themselves: containers must have stable, fitted covers to prevent blowing or scattering refuse and to keep animals out, must be kept clean and in good repair to avoid odor and rodent harborage, and must be marked with the hauler's name and phone number. Importantly, Sec. 42-29(f) provides that stored containers shall not be on public rights-of-way and must be located so they do not block any sidewalk, street, driveway, fire lane, or intersection sight distance, and that containers must be removed from the collection point within 24 hours of service. Because Johns Creek uses an open-market system of registered private haulers, residents arrange cart delivery and service directly with their chosen hauler.
Accumulating rubbish/garbage outside approved containers or leaving carts out improperly can prompt a Code Compliance notice and, if uncorrected, a citation under the general penalty (Sec. 1-7): up to $1,000.00 fine, up to six months imprisonment, or both, with each day a separate offense.
