The Orange County Board of Supervisors regulates yard sales on private property in unincorporated areas. Residents may hold yard sales on the last full weekend of each month without registration, plus two additional registered sales per year. Only secondhand personal property may be sold, and sales must occur in front and side yards of properties with residences.
Under the County's yard sale ordinance for unincorporated areas, residents are permitted to hold yard sales as follows: the last full weekend (Saturday and Sunday) of each month without registration, plus two additional yard sales during the calendar year with registration (each weekend counts as one sale). Only secondhand personal property may be sold — sale of new retail merchandise or food and drinks is prohibited. Yard sales are limited to front and side yards of properties that have residences. The ordinance is enforced, regulated, and monitored by OC Development Services (formerly the Department of Regional Planning), not the Sheriff's Department. Signs advertising garage sales may be placed on the seller's property during the sale but may not be placed on public property, utility poles, or rights-of-way.
Exceeding the permitted frequency, selling new merchandise, or holding sales in unauthorized locations may result in code enforcement action by OC Development Services. Enforcement follows the standard Neighborhood Preservation progressive approach: courtesy notice, notice of violation, and civil citations for repeated non-compliance.
